Terms and Conditions
These Terms and Conditions govern your use of optimocoach.com and the coaching, training and related services provided by OptiMo Fitness Coaching (“OptiMo”, “we”, “us” or “our”). By using our website, enquiring about our services, or signing up to a programme, you agree to these terms. Please read them carefully and keep a copy for your records.
1. About us
OptiMo Fitness Coaching is a London-based fitness coaching business providing online personal training, in-person sessions and body transformation programmes to clients in the United Kingdom and internationally. Our studio is located at The Pill Box, 115 Coventry Road, Bethnal Green, London E2 6GG. You can reach us at any time through our contact page.
2. Eligibility
Our services are intended for adults aged 18 and over. By signing up, you confirm that you are at least 18 years old and able to enter into a binding agreement. If you are under 18, you may only use our services with the involvement and consent of a parent or guardian, where we have agreed to this in advance.
3. Our services
We provide personal training, online coaching, nutrition guidance, and body transformation programmes, delivered in person, at home, or remotely through our coaching app. The exact services included in your programme, along with their duration and price, will be set out and agreed with you before you begin. We reserve the right to adjust the content of a programme where necessary to keep it safe, effective and appropriate for you.
4. Health, fitness and medical disclaimer
You should consult your doctor or a qualified medical professional before starting any new exercise or nutrition programme, particularly if you have a pre-existing medical condition or injury, are recovering from illness or surgery, or are pregnant or postnatal. Our coaching is not a substitute for medical advice, diagnosis or treatment.
By taking part, you confirm that you are in good health and physically able to participate, and you agree to tell us about any medical conditions, injuries, medications or limitations that may affect your training, both before you start and as they arise. You accept that all physical activity carries inherent risks, and that you take part at your own risk.
5. Consultations and booking
We offer a free initial consultation, fitness assessment and taster session so you can decide whether our coaching is right for you before committing to a paid programme. Bookings are confirmed once we have agreed the details of your programme and, where applicable, received your payment.
6. Fees and payment
The fees for your programme are those set out and agreed at the time you sign up, and are payable in advance unless we agree otherwise. Payments are processed securely by our third-party payment provider; we do not store your full card details. Where prices are shown in pounds with approximate equivalents in other currencies, the exact rate applied is set by your card provider on the day of payment.
7. Recurring plans and renewals
Some of our coaching is provided on a recurring monthly basis. Unless stated otherwise, recurring plans continue automatically until you cancel them in line with the notice terms provided when you sign up. You can cancel a recurring plan at any time by contacting us through our contact page; cancellation takes effect at the end of your current paid period.
8. Your right to cancel
If you are a consumer signing up online or otherwise at a distance, you have the right to cancel your agreement within 14 days of entering into it, without giving a reason. If you ask us to begin your coaching within this 14-day period, you may be required to pay for the services already provided up to the point you cancel, and you will lose the right to cancel once the services have been fully performed. To exercise this right, simply let us know through our contact page before the 14 days end.
9. Cancellations, rescheduling and refunds
Beyond the statutory cancellation right described above, the following applies. Once a programme or block of sessions has begun, fees are non-refundable except where required by law or where we are unable to provide the agreed service. In-person or scheduled live sessions cancelled or rescheduled with less than 24 hours’ notice may be treated as used. We understand that circumstances change, and we will always try to be fair and reasonable where you need to pause or reschedule for genuine reasons such as illness or injury.
10. Your responsibilities
To get the most from your coaching and to keep it safe, you agree to:
- give us accurate and complete information about your health, fitness and goals;
- follow the guidance provided and exercise within your own limits;
- use appropriate equipment and a safe environment when training at home or remotely; and
- stop exercising and seek medical advice if you feel unwell or experience pain.
11. Results
We are committed to supporting you with professional, personalised coaching, but individual results depend on many factors including your effort, consistency, starting point, and personal circumstances. For this reason, we cannot and do not guarantee specific fitness, weight or body-composition outcomes.
12. Intellectual property
All training programmes, workout plans, meal plans, videos, written materials and content we provide, whether through our website or coaching app, remain our intellectual property and are provided for your personal use only. You may not copy, share, resell or distribute them without our written permission.
13. Third-party apps and services
Our coaching may involve third-party platforms, such as our coaching app or nutrition and activity tracking tools. We are not responsible for the content, availability or practices of third-party services, which are governed by their own terms and privacy policies.
14. Limitation of liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited by law. Subject to that, we are not liable for loss or damage that is not reasonably foreseeable, or that arises from your failure to follow guidance, disclose relevant health information, or train safely. Our total liability to you in connection with our services will not exceed the fees you have paid for the programme in question.
15. Your privacy
We take your privacy seriously. Details of how we collect, use and protect your personal information, including health and fitness data, are set out in our Privacy Policy.
16. Changes to these terms
We may update these terms from time to time to reflect changes in our services or the law. The version published on this page is the one that applies. Where changes are significant, we will update the date below.
17. Governing law
These terms are governed by the laws of England and Wales, and any disputes will be subject to the courts of England and Wales. If you are a consumer resident in another country, you may still benefit from any mandatory consumer protections that apply where you live.
